Santa Clara Resident Accuses Fast-Food Chain of Negligence After Slip-and-Fall Incident

A Santa Clara resident has filed a lawsuit against a major fast-food chain and its associates, claiming negligence and premises liability after suffering injuries from a slip and fall incident. Anna Maria Morin lodged the complaint on September 5, 2025, in the Superior Court of California for the County of Santa Clara against McDonald’s USA, LLC., Edna Morales, Golden Arch, LP., and other unnamed defendants.

According to the complaint, Anna Maria Morin alleges that on March 17, 2025, she was injured at a McDonald’s location at 1398 W. San Carlos Street in San Jose due to poorly maintained walkway surfaces. The lawsuit accuses McDonald’s USA, LLC., Edna Morales, Golden Arch, LP., and Does 1 through 100 of negligently owning, maintaining, controlling, repairing, inspecting, operating, designing, building, managing, and cleaning the premises. The plaintiff asserts that these actions resulted in a dangerous condition that caused her to slip and fall.

Morin’s complaint highlights that she was lawfully present on the premises for mutual benefit when the incident occurred. She argues that the defendants knew or should have known about the hazardous condition with enough time to rectify it or warn patrons like herself. As a result of this alleged negligence and failure to address safety concerns adequately, Morin claims she sustained serious injuries leading to pain and suffering.

The lawsuit seeks various forms of relief from the court. Morin is asking for general damages according to proof for her pain and suffering as well as special damages covering medical expenses incurred due to her injuries. Additionally, she seeks compensation for lost earnings and diminished earning capacity resulting from her inability to work following the accident. The plaintiff also requests coverage for legal costs associated with bringing forth this action.
