Timothy McCulley, a 35-year-old resident of Escalon in San Joaquin County, was arrested following a federal grand jury indictment on two counts related to the production of child sexual abuse material. The announcement was made by U.S. Attorney Eric Grant.

Court documents allege that McCulley used a minor victim on November 9 and 14, 2024, to engage in sexually explicit conduct for the purpose of creating child sexual abuse material.

The investigation was conducted by the Internet Crimes Against Children Unit within the Sacramento Valley Hi-Tech Crimes Task Force. This unit includes participation from the San Joaquin County Sheriff’s Department and Homeland Security Investigations. Assistant U.S. Attorney Shea J. Kenny is prosecuting the case.

If found guilty, McCulley could face up to 30 years in prison and a $250,000 fine for each count. Sentencing would be determined by the court based on statutory factors and Federal Sentencing Guidelines. The charges remain allegations at this stage; McCulley is presumed innocent unless proven guilty beyond a reasonable doubt.

According to the Department of Justice, this prosecution is part of Project Safe Childhood, an initiative started in May 2006 aimed at addressing child sexual exploitation and abuse across the United States. The program brings together federal, state, and local resources to investigate and prosecute offenders while also working to identify and rescue victims.
