A San Francisco property owner is taking legal action against a tenant, accusing him of fraudulent activities that have resulted in significant financial losses. The complaint was filed by 1212 Hampshire LLC in the Superior Court of California, County of San Francisco, on September 2, 2025, targeting Donald Christian Figueroa as the defendant.
The lawsuit revolves around allegations that Figueroa misrepresented his residency status at a property owned by 1212 Hampshire LLC. According to the complaint, Figueroa had entered into a rental agreement for the premises located at 1212A Hampshire Street back in October 2003. However, it is alleged that he vacated the property by December 2023 and subsequently rented it out to various unknown individuals while falsely claiming to still reside there. This deceit allowed him to collect rent exceeding the original $700 monthly rate agreed upon with the plaintiff, thus profiting unlawfully from subletting activities.
The plaintiff asserts that they were unaware of these actions due to Figueroa’s continued false representations as a resident tenant. As part of their reliance on his claims, they even paid him $8,062 in relocation benefits under the assumption he was living on-site when renovations necessitated temporary vacancy. “Had Plaintiff known the truth,” states the complaint, “Plaintiff would have taken action to recover possession of the Premises.” The document outlines multiple causes of action including fraud and deceit through intentional misrepresentation and concealment under Civil Code §§ 1572(1), 1710(1), unjust enrichment, and elder abuse given one of its stakeholders’ age.
In terms of relief sought from this legal battle, 1212 Hampshire LLC demands general damages amounting to no less than $169,986 alongside special damages yet to be determined. They are also pursuing treble damages under certain fraud claims as well as double damages for elder abuse violations involving Lois A. Connolly—a trustee with ownership interest over part of said property who qualifies as an elder under California law due to her age being over sixty-five years old during all relevant times mentioned within this case filing.
