A family is seeking justice following the tragic death of their loved one, allegedly due to medical negligence. On August 22, 2025, Eckhard Hunder, Karl Hunder, and Diana Tilden filed a complaint in the Superior Court of California, County of Ventura against Coastal View Healthcare Center LLC and Community Memorial Health System. The plaintiffs are pursuing claims related to wrongful death, medical malpractice through a survival action, negligent infliction of emotional distress, and loss of consortium.
The lawsuit centers around the death of Gisselle Hunder on September 14, 2024. According to the complaint, Gisselle was under the care of Coastal View Healthcare Center when she suffered a fall while being transferred from her bed to a wheelchair on June 12, 2024. This incident resulted in a severe leg laceration that required ongoing wound care. The plaintiffs allege that this injury was compounded by an infection contracted at the facility which impeded her recovery and led to significant weight loss. Further negligence is claimed during her stay at Community Memorial Health System where another traumatic event occurred on September 6, 2024, leading to further injuries from which she could not recover.
The plaintiffs argue that both healthcare facilities failed to meet the standard of care expected from medical professionals and that their negligence directly contributed to Gisselle’s suffering and eventual death. “Defendants negligently failed to possess and exercise that degree of knowledge and skill ordinarily possessed by other physicians,” states the complaint. As a result of these alleged failures, Gisselle’s family has endured significant emotional distress and financial burdens.
In addition to seeking general damages for wrongful death and pre-death non-economic losses such as pain and suffering experienced by Gisselle before her passing, the plaintiffs are also claiming compensation for economic losses including funeral expenses and loss of financial support. Furthermore, Eckhard Hunder is pursuing damages for negligent infliction of emotional distress after witnessing his wife’s injury firsthand.
