Plaintiffs Allege Medical Negligence Against Sutter Health Resulting in Permanent Injuries

A Sacramento family has taken legal action against a prominent healthcare provider, alleging medical negligence that has resulted in significant harm. The complaint was filed by Kenneth M. Sigelman & Associates on January 28, 2026, in the Superior Court of California, County of Sacramento, naming Sutter Health and its affiliates as defendants.

The plaintiffs in this case are Marcel McCrary, a minor represented by his guardian ad litem Marcellus Dante McCrary, and Mariah Addison. They have brought forth allegations against Sutter Health; Sutter Medical Center Sacramento; Capital OB/GYN, Inc.; and several medical professionals including Dr. Irwin Endelman, Dr. Penny Larson, Dr. Abraham J. Sklar, and Amber J. Gallaty, C.N.M., among others listed as DOE defendants. The lawsuit centers around events occurring on or about November 3, 2024, when the defendants allegedly failed to provide adequate medical care during treatment procedures involving both plaintiffs.

According to the complaint, the plaintiffs claim that the medical staff involved did not possess or exercise the necessary degree of knowledge or skill expected from professionals in their field. This alleged lack of competence led to improper diagnosis and treatment which resulted in injuries that could have been avoided with proper care. The plaintiffs also accuse the defendants of failing to inform them about potential risks associated with their treatments and surgeries.

The complaint further asserts that due to these failures, Marcel McCrary suffered permanent injuries affecting his health and future earning capacity while Mariah Addison experienced a loss of income due to her inability to attend her usual occupation following the incident. Additionally, it is claimed that the defendants attempted to conceal their negligence by withholding information regarding the true nature of the injuries sustained by the plaintiffs.

In seeking justice for these grievances, Marcel McCrary’s representatives are asking for compensation covering past and future general damages along with medical expenses incurred due to ongoing care needs stemming from this alleged negligence. They also seek reimbursement for lost earnings potential alongside prejudgment interest and coverage for legal costs incurred during this process.

Similarly, Mariah Addison is pursuing claims for both past and future damages related to her medical expenses as well as losses tied directly back into missed work opportunities caused by complications arising out from what she perceives was substandard healthcare provided under defendant’s watchful eye.
