A legal battle is brewing in California as two former employees have taken their grievances to court, accusing their previous employer of multiple labor law violations. The complaint was filed by Carlos Sarabia and Juan Robledo on October 16, 2025, in the Superior Court of California, County of Santa Clara, against MBKT Corp doing business as Pacific Coast Home Services and its owner Kim W. Hancock.

The plaintiffs allege that MBKT Corp systematically violated California labor laws by failing to pay overtime wages, provide adequate meal and rest breaks, reimburse business expenses, and issue accurate wage statements. According to the complaint, the company employed a flawed “alternative workweek” system where employees were expected to work four ten-hour days without proper overtime compensation. This system was deemed invalid as it lacked a secret ballot election registered with the State of California and was inconsistently applied based on workload demands.

Sarabia and Robledo claim they were not compensated for all hours worked, including time spent driving company vans which doubled as mobile advertisements for Pacific Coast Home Services. They assert that they were restricted from using these vehicles for personal errands during commutes and were charged a “Daily Vehicle Use” fee deducted from their wages. Furthermore, Robledo alleges he was misclassified as a salaried employee despite performing non-exempt tasks over 50% of his working hours.

The plaintiffs argue that these practices constitute unfair business practices under California’s Unfair Competition Law (UCL), seeking restitution for unpaid wages and other damages. They demand compensatory damages for unpaid wages and overtime, reimbursement for business expenses, meal and rest period premiums, pre-judgment interest on unpaid amounts, attorney’s fees, costs of action, declaratory judgment declaring the employer’s actions unlawful under UCL, an injunction against further unlawful practices by the defendants.
