A California resident with physical disabilities has filed a lawsuit against a retail store for alleged violations of accessibility laws. The complaint was filed by Andy Martin in the Superior Court of California, County of Ventura, on September 4, 2025, targeting Zumiez Inc. and associated parties.
The case revolves around an incident that occurred on May 13, 2025, when Andy Martin visited a Zumiez store located at 180 W. Hillcrest Drive, Suite 5, Thousand Oaks, CA. Martin, who is paraplegic and relies on a wheelchair for mobility, encountered architectural barriers in the form of narrow merchandise aisles that prevented him from accessing the store’s offerings fully. “Plaintiff wanted but was unable to maneuver several of the store’s merchandise displays because they failed to offer accessible routes,” the complaint states. This experience caused Martin difficulty and embarrassment as he was unable to shop like other patrons due to these barriers.
Martin’s legal action cites violations of both state and federal laws designed to protect individuals with disabilities. Specifically, the lawsuit alleges that Zumiez Inc. violated the Americans with Disabilities Act (ADA) and California’s Unruh Civil Rights Act by failing to provide equal access to its facilities. According to the complaint, “Defendants fail and continue to fail to maintain in working and usable conditions the facilities… required to provide equal access.” The plaintiff argues that these barriers are easily removable without much difficulty or expense.
The plaintiff seeks injunctive relief compelling Zumiez Inc. to comply with accessibility laws by removing all barriers related to his disability at their location. Additionally, Martin is pursuing damages under the Unruh Civil Rights Act which mandates actual damages along with a statutory minimum penalty of $4,000 per violation. He also requests reasonable attorney’s fees and litigation costs as part of his relief sought from the court.
