A class action lawsuit has been filed against a company accused of multiple labor law violations affecting numerous employees. On October 9, 2025, Jose Castillo Garcia filed the complaint in the Superior Court of California, County of Sacramento, against F&S Produce West LLC. The case alleges that the company systematically violated wage and hour laws, leading to unfair competition and financial harm to its employees.
The lawsuit claims that F&S Produce West LLC failed to pay minimum and overtime wages, did not provide lawful meal periods or rest breaks, neglected to reimburse business expenses, and issued inaccurate wage statements. According to the complaint, these actions were deliberate attempts by the company to increase profits at the expense of its workers’ rights under California labor laws. “Defendants have increased their profits by violating state wage and hour laws,” Garcia asserts in the filing. The alleged violations span several sections of the California Labor Code and Industrial Welfare Commission Wage Orders.
Garcia seeks monetary relief for himself and other similarly situated employees in California. The lawsuit demands compensation for unpaid wages, unreimbursed business expenses, benefits, interest, attorneys’ fees, costs and expenses, as well as penalties under various sections of the Labor Code. Additionally, Garcia is pursuing injunctive relief to prevent further violations by F&S Produce West LLC. The plaintiff’s legal team argues that a class action is necessary due to the large number of affected employees and common legal questions regarding the company’s practices.
