Shelita Law, a caregiver from Sunnyvale, California, has filed a lawsuit alleging severe racial discrimination and harassment by her former employers. The complaint was filed on October 29, 2025, in the Superior Court of California, County of Santa Clara against Jason Fox and Kerri Fox. The lawsuit outlines numerous allegations including racial discrimination, harassment, and assault during her employment with the defendants.
The case unfolds with Shelita Law detailing her employment history with the Fox family. Initially employed through One Plus One Care to care for Roberta Fox, she later became a direct employee of Jason Fox in September 2024 after he bought out her contract. During this period, she claims to have endured long working hours without overtime pay and faced repeated racial slurs and derogatory remarks from Jason Fox. According to the complaint, Jason referred to Law using terms like “chattel,” “colored girl,” and other offensive language targeting her race and weight.
Despite raising these issues with Kerri Fox multiple times, Shelita alleges that no remedial action was taken. Instead, she was encouraged to continue working under the same conditions. The situation escalated on January 6, 2025, when an altercation occurred at the Fox residence. Shelita claims that after expressing her unwillingness to tolerate further discriminatory treatment, Jason physically assaulted her. In trying to protect Roberta Fox during this incident, Shelita sustained injuries that were reportedly ignored by the family’s workers’ compensation process.
Shelita Law’s legal action seeks substantial damages for emotional distress and financial losses due to what she describes as a hostile work environment perpetuated by both Jason and Kerri Fox. Her lawsuit accuses them of violating California’s Fair Employment and Housing Act (FEHA) by failing to prevent harassment and discrimination based on race, color, and national origin. Additionally, it charges them with retaliation following her complaints about their conduct.
In response to these alleged violations of public policy and personal safety through assault and battery by Jason Fox specifically, Shelita is pursuing punitive damages aimed at punishing the defendants for their actions while also seeking compensatory relief for ongoing psychological trauma such as anxiety and depression resulting from her experiences.
