The complaint also accuses Skyworks Solutions of failing to pay all due wages during employment and upon termination, further exacerbating the grievances.

The lawsuit is being pursued under PAGA, which allows aggrieved employees to file lawsuits on behalf of themselves and other affected workers for labor code violations. Estrada seeks civil penalties from Skyworks Solutions for these alleged infractions. The penalties sought include $100 per employee per pay period for initial violations and $200 for subsequent ones under California Labor Code § 2699. Additional penalties are sought under various sections of the Labor Code related to wage payment failures and inadequate record-keeping.

In his prayer for relief, Estrada requests civil penalties as prescribed by statute for each violation committed by Skyworks Solutions. He also seeks reimbursement for attorney fees and costs associated with bringing this action forward. This lawsuit underscores significant challenges facing employers regarding compliance with state labor laws.
