In a dramatic turn of events, a California resident has taken legal action against a prominent orthopedic surgeon and two medical corporations, alleging severe medical negligence that resulted in permanent injuries. On November 10, 2025, Miles Clarke filed a complaint in the Superior Court of California, County of Santa Clara, accusing Dr. Jeffrey Kanel and his affiliated organizations, Golden State Orthopedics & Spine and OrthoNorCal, Inc., of failing to provide adequate medical care.

The lawsuit details the harrowing experience of Miles Clarke, who claims that in August 2023, the defendants negligently failed to diagnose and treat an infection in his ankle. This oversight allegedly led to severe and lasting physical harm. According to the complaint, Clarke suffered substantial injuries due to this negligence and is now seeking justice through the court system. “Plaintiff has suffered and will continue to suffer substantial and permanent physical and emotional pain,” states the filing. The case accuses Dr. Kanel specifically of failing in his duty as an orthopedic surgeon practicing within Santa Clara County.

Moreover, the complaint extends its allegations to Golden State Orthopedics & Spine and OrthoNorCal, Inc., asserting corporate negligence. It claims these entities were negligent in hiring, retaining, supervising, and training their medical staff who provided care to Clarke. The plaintiff argues that these organizations failed in their responsibilities by not ensuring competent medical personnel were employed and adequately supervised.

Miles Clarke is seeking various forms of relief from the court including general damages for pain and suffering as well as special damages related to medical expenses incurred due to the alleged negligence. He also seeks compensation for lost wages resulting from his inability to work following his injuries. The plaintiff’s demands underscore the significant impact this incident has had on his life both physically and financially.

Representing Miles Clarke are attorneys Nancy Hersh and Kate Hersh-Boyle from Hersh & Hersh law firm based in San Francisco. The case is being reviewed under Case ID 25CV479774 by Judge Y. Chavez at the Superior Court of California in Santa Clara County.
