A severe allergic reaction at a local restaurant has led to a legal battle, as a California resident seeks justice for what she claims was a negligent oversight. Brittany Mills filed a complaint on September 2, 2025, in the Ventura Superior Court against Oak & Iron, alleging negligence and strict liability after suffering an anaphylactic reaction due to undisclosed allergens in her drink.

The lawsuit, initiated by Brittany Mills with representation from the Law Offices of John M. Walker, accuses Oak & Iron of failing to warn her about the presence of eggs in her beverage despite her explicit inquiry. The incident occurred on September 9, 2023, when Mills visited the Thousand Oaks establishment and informed the server of her severe egg allergy. Despite assurances that her drink contained no egg products, Mills experienced a life-threatening allergic reaction shortly after consumption. The complaint details how this incident resulted in physical pain and emotional distress for Mills, alongside other damages such as loss of employment earnings and enjoyment of life.

Mills’ legal team argues that Oak & Iron had a duty to exercise reasonable care in food preparation and service by disclosing known allergens upon customer inquiry. They claim that the restaurant breached this duty by providing false assurances regarding the safety of the drink consumed by Mills. As stated in the filing: “Defendants breached this duty by failing to disclose the presence of eggs or egg products in the drink and by providing false assurances of safety upon which Plaintiff reasonably relied.”

The complaint includes two causes of action: negligence and strict liability for failure to warn. Under these claims, Mills asserts that Oak & Iron’s actions were directly responsible for her injuries and subsequent losses. She is seeking general damages, special damages, compensation for lost earnings, costs incurred during litigation, prejudgment interest, and any additional relief deemed appropriate by the court.
