Patricia C. Fitzharris has filed a compelling lawsuit against several senior living and wellness entities, accusing them of medical negligence that resulted in severe injuries. The complaint was filed on September 24, 2025, in the Superior Court of California, County of Ventura, targeting EmpowerMe Wellness, LLC; MBK Senior Living, LLC; The Reserve at Thousand Oaks; and Tracy Cheevers among others.

According to the court documents, Patricia C. Fitzharris alleges that she did not receive the promised standard of care during her physical therapy sessions at these facilities. She claims that the defendants failed to provide competent physical therapy services and proper supervision, which led to her falling and sustaining significant injuries. Fitzharris accuses the defendants of negligence for failing to adhere to established care protocols and for allowing unqualified staff members to administer treatment.

The lawsuit outlines that Fitzharris engaged with EmpowerMe Wellness and related entities starting on or before June 28, 2024. She expected professional care tailored to her rehabilitation needs but was met with substandard service that compromised her safety. In particular, Tracy Cheevers is named as a registered physical therapist who allegedly failed to provide adequate care and supervision during therapy sessions.

Fitzharris asserts that this negligence directly resulted in her fall and subsequent injuries, which have had life-altering consequences. She highlights the failure of EmpowerMe Wellness and its affiliates to properly train and supervise their staff as a critical factor in the breach of duty owed to her as a patient.

In pursuit of justice, Patricia C. Fitzharris seeks both economic and non-economic damages from the court. Her demands include compensation for past and future medical expenses incurred due to the injuries sustained under the defendants’ care. Additionally, she seeks damages for pain and suffering, loss of enjoyment of life, emotional distress, disfigurement, and other related hardships caused by the alleged negligence.
