Margarita Burnette has taken legal action against a prominent educational institution, alleging medical negligence that resulted in severe health complications. On October 30, 2025, Wilcoxen Callaham, LLP filed a complaint on behalf of Burnette in the Superior Court of California, County of Sacramento, targeting The Regents of the University of California as the defendant.

The lawsuit stems from a series of alleged medical oversights by the defendants during their treatment of Burnette. According to the complaint, the defendants failed to exercise due care and skill expected from medical practitioners in handling Burnette’s medical needs. Specific allegations include neglecting proper follow-up on a pulmonary nodule discovered in January 2022 and misplacing a tunneled pleural catheter in November 2024. These actions allegedly led to metastatic disease progression and significant iatrogenic harm. Burnette claims these negligent acts resulted in her suffering severe physical and psychological injuries, including malignant pleural effusion and infections requiring extensive medical interventions.

Burnette accuses The Regents of the University of California and unnamed parties (Does 1 through 50) of breaching their duty by failing to provide competent medical care. She asserts that each defendant was involved as an agent or employee within their scope of employment when the alleged negligence occurred. The plaintiff is seeking compensation for general damages exceeding the court’s minimum jurisdiction, covering past and future medical expenses, lost wages due to her inability to work, and other incidental costs incurred because of her injuries.

The plaintiff’s legal team is pursuing several forms of relief from the court. They are asking for general damages based on trial evidence, reimbursement for all related medical expenses, compensation for lost earnings both past and future, interest on all damages at lawful rates, coverage for legal costs incurred during this suit, and any additional relief deemed appropriate by the court.
