Plaintiff Alleges Major Auto Manufacturer Breached Warranties on Defective Vehicle

A California resident has taken legal action against a major automobile manufacturer, alleging that the company failed to honor both implied and express warranties on a vehicle purchase. Gerardo Arambula Morones filed the complaint in the Superior Court of California, County of Santa Clara, on October 15, 2025, targeting Volkswagen Group of America, Inc.

The case revolves around a 2022 Volkswagen Atlas purchased by Morones, which he claims was defective from the outset. According to the complaint, Volkswagen provided an express written warranty for the vehicle; however, Morones alleges that the vehicle was not in merchantable condition at delivery. He asserts that it failed repeatedly and did not meet safety or reliability standards expected of such a motor vehicle. The plaintiff contends that these issues were not due to any misuse or modifications on his part.

Morones accuses Volkswagen of breaching both implied and express warranties. He states that at the time of purchase, defendants implicitly warranted that the vehicle was fit for its intended use. However, he argues this was not the case due to multiple manufacturing defects and design flaws rendering it unsafe and unreliable. “As a direct and proximate result of Defendants’ breach,” Morones claims, “the VEHICLE is virtually useless due to frequent breakdowns.” Additionally, he accuses Volkswagen of violating California’s Song Beverly Consumer Warranty Act by failing to repair or replace the defective vehicle after numerous attempts.

In seeking judgment from the court, Morones requests several forms of relief: reimbursement for financing and owning costs associated with the vehicle; rescission of the purchase agreement; restitution damages; attorney’s fees; and civil penalties as stipulated under Civil Code Sections 1793.2 and 1794. He also seeks pre-judgment interest at the legal rate along with other appropriate relief deemed proper by the court.
