Plaintiff alleges labor law violations against former employer

Javier Ramos has taken a bold step in seeking justice against alleged labor violations by his former employers. On February 6, 2026, Ramos filed a complaint in the Superior Court of California, County of Santa Clara, against California Surety Investigations, LLC; Western Surety Investigators, LLC; Triton Management Services, LLC; and Two Jinn, Inc., accusing them of multiple breaches of the California Labor Code under the Private Attorneys General Act (PAGA).

Ramos’s lawsuit details a series of grievances during his employment from August 2024 to October 2025. He claims that these companies systematically failed to compensate him and other employees for all hours worked, including overtime and minimum wages. The complaint alleges violations such as not providing required meal and rest breaks, failing to pay earned wages bi-monthly, and not maintaining accurate records. “Defendants’ failure to provide and maintain records required by the California Labor Code deprived Plaintiff and certain Aggrieved Employees the ability to know…the accuracy of their hours worked,” states the filing.

The plaintiff further accuses his former employers of willfully neglecting their legal obligations despite being aware of these issues. According to Ramos, this disregard for employee rights was deliberate and systemic across their operations in California. His legal action is not just for personal redress but also seeks penalties on behalf of other affected employees and the State of California. This case underscores the critical role PAGA plays in enabling workers to act as private attorneys general when state enforcement is lacking.

In terms of relief sought, Ramos requests civil penalties as permitted by PAGA along with declaratory and injunctive relief. He emphasizes that he is not pursuing general damages but aims solely for statutory penalties due to the alleged infractions. The lawsuit calls for judicial acknowledgment that these practices violated labor laws while demanding financial penalties to deter future misconduct.
