The complaint details how Jackson’s requests for modified duties were consistently ignored by Pinnacle Live’s management. Instead of providing alternative work assignments or exploring temporary reassignment options within his documented restrictions, Jackson was placed on involuntary medical leave without pay. Despite numerous medical reports indicating that he could perform modified work activities within certain limitations, Pinnacle Live maintained that no such positions were available unless he was fully cleared for unrestricted duty.
Jackson’s legal team argues that this refusal to accommodate constitutes a violation of the Fair Employment and Housing Act (FEHA), which mandates employers to make reasonable accommodations for employees with known disabilities. They assert that Pinnacle Live’s actions were not only discriminatory but also retaliatory since Jackson had engaged in protected activities by filing a workers’ compensation claim and requesting accommodations.
In addition to claims of failure to accommodate and engage in an interactive process, the lawsuit accuses Pinnacle Live of wrongful termination based on disability discrimination and retaliation under FEHA’s public policy provisions. The complaint highlights how Jackson was terminated solely due to his disability-related needs despite being able to perform essential job functions with reasonable accommodation.
The plaintiff seeks general damages exceeding $1 million for emotional distress alongside special damages surpassing another $1 million for economic losses incurred due to lost earnings during his involuntary leave period.
