Plaintiff Alleges Former Employer Misclassified Her Role Leading To Wrongful Termination

Laura Espinoza has filed a lawsuit against her former employer, alleging a series of employment law violations that paint a troubling picture of workplace discrimination and retaliation. The complaint was lodged on February 19, 2026, in the Superior Court of California, County of Sacramento, targeting K. Hovnanian Companies, LLC as the defendant.

The plaintiff, Laura Espinoza, claims she was wrongfully terminated from her position at K. Hovnanian Companies due to discrimination related to her medical condition and subsequent leave. Espinoza’s legal action includes accusations of misclassification as an exempt employee to avoid paying overtime wages, failure to provide meal and rest periods, and other labor code violations. According to the complaint, Espinoza was employed by the defendant starting February 20, 2020, as a Sales Consultant in Sacramento County. Despite working over forty hours weekly and fulfilling her duties competently without any disciplinary issues, she alleges that she was not compensated for overtime due to being misclassified as an exempt employee.

Espinoza further asserts that after taking medical leave in February 2023 due to a serious health condition—leave which was initially approved by her employer—she faced unreasonable demands for documentation upon returning. She alleges that despite providing evidence from her doctor about their temporary unavailability until May 9, 2023, K. Hovnanian Companies refused to accommodate this delay and terminated her employment effective May 9th. This termination is claimed to be pretextual and motivated by discriminatory reasons linked to her medical leave.

In seeking justice through the court system, Espinoza is asking for compensatory damages for lost wages and benefits, emotional distress damages due to the wrongful termination and hostile work environment she endured. Additionally, she seeks punitive damages on grounds that the defendant acted with malice or reckless disregard for her rights under California’s Fair Employment and Housing Act (FEHA) among other statutes. The complaint also demands restitution for unpaid wages along with attorneys’ fees and costs incurred during litigation.
