A recent legal complaint has been filed against a prominent car dealership and an insurance company, accusing them of fraudulent practices in the sale of a used vehicle. The lawsuit was initiated by Briana Nevarez on September 10, 2025, in the Superior Court of California, County of Santa Clara, targeting Stevens Creek Motors, Inc., operating as AutoNation Acura Stevens Creek, and Liberty Mutual Insurance Company.

Briana Nevarez alleges that she was misled into purchasing a 2013 BMW X3 XDrive from Stevens Creek Motors under false pretenses. According to the complaint, the dealership assured her that the vehicle was in “perfect condition” and came with a 90-day/4,000-mile express warranty. However, after purchasing the car and driving it back to Orange County from Santa Clara on June 11, 2025, she discovered significant mechanical issues. The dealership had allegedly concealed known problems with the vehicle’s engine and timing chain that were present before the sale. Nevarez claims she would not have purchased the vehicle or an extended warranty had she been aware of these issues.

The plaintiff accuses Stevens Creek Motors of multiple violations including intentional misrepresentation, concealment of material facts about the vehicle’s condition, negligent misrepresentation, and breaches under California’s Consumers Legal Remedies Act (CLRA) and Unfair Competition Law (UCL). She further contends that Liberty Mutual Insurance Company is liable under a surety bond issued to cover fraud committed by dealerships like Stevens Creek Motors.

Nevarez seeks rescission of her purchase contract for $19,714.00 along with restitution for this amount. Additionally, she demands actual damages equating to $19,714.00 plus incidental and consequential damages totaling $7,500.00. The complaint also calls for punitive damages against Stevens Creek Motors for their alleged fraudulent conduct while seeking injunctive relief to prevent further deceptive practices by the defendants.
