Nissan North America, Inc. is facing serious allegations in a lawsuit filed by an individual consumer over claims of defective vehicle sales and breaches of warranty obligations. On November 10, 2025, Ninad Chavan filed a complaint in the Superior Court of California, County of Santa Clara, against Nissan North America, Inc., alleging violations of the Song-Beverly Consumer Warranty Act and other unfair business practices.
The case centers around a 2019 Nissan Leaf purchased by Chavan on February 13, 2022. The plaintiff asserts that the vehicle suffered from significant defects that impaired its use, value, and safety. Despite multiple repair attempts at authorized facilities, these issues were not resolved within the warranty period. Chavan argues that Nissan failed to uphold its express and implied warranties under the Song-Beverly Consumer Warranty Act. According to the complaint, “Defendants violated the Song-Beverly Consumer Warranty Act by failing to conform the Vehicle to the express written warranties within a reasonable number of repair attempts or within the warranty periods.”
Chavan further accuses Nissan of engaging in unlawful and unfair business practices as defined under California’s Business and Professions Code § 17200. The plaintiff alleges that Nissan knowingly sold vehicles with defective components and misled consumers about their rights under warranty laws. The complaint highlights several alleged wrongdoings including failure to provide adequate repair services and misleading advertising practices.
In seeking relief from the court, Chavan demands rescission of the sales contract for the vehicle, restitution amounting to $23,611.28 along with consequential damages according to proof at trial. Additionally, Chavan seeks civil penalties amounting to twice the actual damages due to what is described as willful non-compliance by Nissan with warranty obligations. The plaintiff also requests attorney’s fees and expenses incurred during this legal action.
Represented by attorney Natalee Fisher from MFS Legal Inc., Chavan aims for both injunctive reliefs to prevent further alleged unfair practices by Nissan and an order requiring them to account for all profits gained through such actions.
