Stephen Bingham, a California resident, has taken legal action against a major automotive corporation, alleging significant breaches of warranty and unfair business practices. On November 12, 2025, Bingham filed a complaint in the Superior Court of California, County of Santa Clara, against Nissan North America Inc., citing multiple violations related to his purchase of a 2022 Nissan Leaf EV.

The lawsuit stems from Bingham’s acquisition of the vehicle on November 12, 2021. He claims that the car did not conform to express written warranties due to defects and malfunctions that impaired its use and safety. Despite numerous repair attempts at authorized facilities, these issues persisted. Bingham accuses Nissan North America Inc. of violating the Song-Beverly Consumer Warranty Act by failing to either replace the defective vehicle or provide restitution. He argues that this failure was willful as the company was aware of the defects but neglected its obligations under the warranty act.

Bingham’s complaint outlines three primary causes of action: breach of express warranties under the Song-Beverly Consumer Warranty Act, breach of implied warranty under the same act, and violation of California’s Business and Professions Code § 17200 for unfair competition. The latter claim includes allegations that Nissan engaged in unlawful business practices by selling vehicles with known defects and misleading consumers about their rights under warranty laws.

The plaintiff seeks several forms of relief from the court. These include rescission of the sales contract, actual damages amounting to $46,620.47, consequential damages, restitution for all payments made towards the vehicle, civil penalties up to twice his actual damages under the Song-Beverly Act, attorney’s fees, prejudgment interest at the highest legal rate, and injunctive relief to prevent further unfair practices by Nissan.
