A class action lawsuit has been filed against a prominent aviation company, alleging multiple violations of California labor laws. The complaint was lodged by Freddy Vazquez on October 22, 2025, in the Superior Court of California, County of Santa Clara, targeting Archer Aviation Inc. and its operating corporation. This legal action seeks to address alleged systemic wage and hour violations that have affected numerous employees.
Freddy Vazquez, acting individually and on behalf of similarly situated individuals, accuses Archer Aviation Inc., Archer Aviation Operating Corp., and unnamed defendants (Does 1 through 100) of engaging in unlawful employment practices. The lawsuit highlights several grievances including unpaid overtime, failure to provide meal and rest breaks, unpaid minimum wages, and non-compliant wage statements. According to the complaint, these actions constitute breaches of various sections of the California Labor Code such as §§ 510 and 1198 for unpaid overtime and §§ 226.7 and 512(a) for meal period premiums.
The plaintiff claims that during his employment from April 2023 to January 2025, he was subjected to unfair labor practices including being denied proper compensation for overtime work due to incorrect calculation methods which excluded certain bonuses and differential pay. Vazquez further alleges that Archer Aviation failed to provide required meal periods or compensate for missed breaks as mandated by law. “Defendants’ conduct was willful or reckless,” the complaint asserts, emphasizing the intentional nature of these alleged violations.
The lawsuit seeks class certification for all current and former hourly-paid or non-exempt employees who worked for Archer Aviation within California over the past four years. The relief sought includes compensatory damages for unpaid wages, statutory penalties under relevant labor codes, restitution under California Business & Professions Code §17200 et seq., injunctive relief to prevent future violations, as well as attorneys’ fees and costs associated with the litigation.
