A California resident is taking legal action against a major automotive corporation and its dealership, alleging multiple breaches of warranty and consumer protection laws. On November 10, 2025, Jaewoong Jung filed a complaint in the Superior Court of California, County of Santa Clara, against Nissan North America Inc., Premier Nissan of San Jose LLC, and unnamed defendants. The case revolves around a defective vehicle purchase that has left the plaintiff seeking damages and other forms of relief.
The lawsuit details how Jaewoong Jung purchased a 2022 Nissan Leaf on December 2, 2021. The plaintiff claims that the vehicle did not conform to express written warranties due to defects that impaired its use, value, and safety. According to the complaint, despite numerous repair attempts by authorized facilities, the issues were not resolved within the warranty period. Jung accuses Nissan North America Inc. and Premier Nissan of San Jose LLC of violating the Song-Beverly Consumer Warranty Act by failing to replace or refund the vehicle as required under California law.
Jung’s legal team argues that these failures were willful since the defendants allegedly knew about the vehicle’s defects but chose not to address them adequately. This neglect has led to ongoing damages for Jung, who seeks restitution equivalent to the vehicle’s purchase price. Additionally, under California Civil Code §1794(c), Jung demands civil penalties amounting to twice his actual damages due to what he perceives as deliberate non-compliance with warranty obligations.
The complaint further alleges breaches of implied warranties under the Song-Beverly Act and violations of California Business & Professions Code §17200 regarding unfair competition practices. It accuses Nissan North America Inc. of knowingly selling vehicles with defective components without informing consumers about their rights under state law. Moreover, Premier Nissan is charged with negligent repair efforts that failed to meet industry standards.
Jung is pursuing several remedies from the court: rescission of the sales contract; declarations confirming reasonable repair attempts were made; actual damages totaling $42,035.84; consequential damages; restitution; civil penalties; attorney fees; prejudgment interest; injunctive relief against further unfair practices by defendants; and an accounting for profits derived from such practices.
