A California resident has filed a lawsuit against an automobile dealer and an insurance company, alleging fraudulent misrepresentation and violations of consumer protection laws. The complaint was filed by Baorong Lin in the Superior Court of California, County of Sacramento, on October 29, 2025, against Edis Obradovic, doing business as Mostar Motors, and Jet Insurance Company.
Baorong Lin’s legal action stems from her purchase of a used 2019 Nissan Rogue Sport from Mostar Motors on April 13, 2025. She accuses the dealership of falsely advertising the vehicle as being in “excellent condition” with a clean title and no need for repairs. Lin claims that these representations were misleading as the car had previously been a rental vehicle in Hawaii that suffered flood damage and was declared salvage before being sold at auction. The lawsuit states that this crucial information was not disclosed to her at the time of purchase.
Lin alleges that shortly after buying the car for $13,465.00, it began exhibiting severe mechanical issues such as stalling and power loss while driving. Inspections revealed signs consistent with water submersion, including mud and debris in the HVAC system and engine bay. Supporting documents like CarFax and AutoCheck reports confirm the vehicle’s prior rental status and flood damage history.
The plaintiff contends that Mostar Motors violated several statutory duties under California law by failing to disclose these facts, thereby engaging in deceptive business practices. The complaint cites violations of the Consumers Legal Remedies Act (Civ. Code §1750 et seq.), Business and Professions Code Section 17200 et seq., Vehicle Code §§11711 et seq., among others.
Lin seeks rescission of the purchase transaction along with restitution for all monies paid for the car, totaling $13,465.00 plus $758.00 in repair costs. Additionally, she demands recovery of attorney’s fees under applicable consumer protection statutes and punitive damages due to what she describes as malicious conduct by Mostar Motors. She also requests an injunction requiring the dealership to reform its sales practices to prevent future misrepresentations.
The lawsuit names Charles D. Marshall from Marshall Law Firm as Lin’s attorney while Edis Obradovic is represented through his business entity Mostar Motors without specific legal representation mentioned for him or Jet Insurance Company within this document context. The case is identified under Case No. Sty O25 91 Bi.
