Plaintiff accuses local pizzeria operators of ADA violations over inaccessible website

A visually impaired woman has taken legal action against a local pizzeria, claiming its website is inaccessible to those with disabilities. Chelette Dewees filed a complaint on November 14, 2025, in the Superior Court of California for the County of Santa Clara against Baldeep Sangha and Gurpreet Sangha, doing business as Bill & Bali’s Pizza. The lawsuit accuses the defendants of failing to make their website accessible to blind and visually impaired individuals, violating several civil rights laws.

According to the complaint, Dewees is legally blind and relies on screen-reading software to access online content. She attempted to use Bill & Bali’s Pizza’s website on October 28, 2025, but encountered numerous barriers that prevented her from making an online order. The lawsuit alleges that these barriers are in violation of the Americans with Disabilities Act (ADA), California’s Unruh Civil Rights Act, and the California Disabled Persons Act. “Being unable to access websites puts individuals at a great disadvantage in today’s society,” Dewees states in her complaint, highlighting the importance of digital accessibility.

The plaintiff argues that the defendants have failed to design and maintain their website in a manner that is fully accessible to visually impaired users. This failure allegedly denies them equal access to goods and services offered by Bill & Bali’s Pizza both online and at their physical location in Walnut Creek, California. The lawsuit seeks a permanent injunction requiring the defendants to hire a qualified consultant who will assist them in improving website accessibility. Additionally, it demands periodic training for employees involved in web development and regular audits to ensure ongoing compliance with accessibility standards.

Dewees is seeking statutory damages under California law for each offense, along with attorney fees and costs associated with bringing this action. The case underscores the growing need for businesses to ensure their digital platforms are accessible to all users, including those with disabilities.
