In a significant legal move, a former employee has taken action against a property management company for alleged labor violations. David Tovar filed a complaint on September 8, 2025, in the Superior Court of California, County of Santa Clara, accusing Windsor Property Management Company of numerous infractions under the Private Attorneys General Act (PAGA).

David Tovar, representing himself and other aggrieved employees, claims that Windsor Property Management Company failed to comply with several labor laws. These include not paying for all hours worked, neglecting to provide meal and rest periods, failing to maintain accurate records of hours worked and meal periods, and not furnishing accurate wage statements. The complaint highlights that these actions are in violation of the California Labor Code ยงยง 2698 et seq., which mandates fair treatment and compensation for employees. “Wages are not ordinary debts,” the filing states, emphasizing the critical nature of wage-and-hour laws in fostering a stable job market.

The lawsuit details various allegations against Windsor Property Management Company. Tovar asserts that during his employment from November 2019 to August 2024 as an hourly-paid non-exempt employee in Santa Clara County, he was subjected to unlawful work conditions. He claims he was regularly required to work more than eight hours per day without proper overtime compensation and was denied legally mandated meal and rest breaks. Additionally, Tovar alleges that upon termination or resignation, employees were not paid their due wages promptly as required by law.

Tovar’s complaint seeks civil penalties on behalf of himself and other similarly affected employees under PAGA. He is asking the court for declaratory relief acknowledging the company’s violations, injunctive relief to prevent further infractions, and monetary penalties for each infraction committed by Windsor Property Management Company. The plaintiff also seeks attorney’s fees and costs incurred during this legal process.
