A California resident has filed a class action lawsuit against a former employer, accusing the company of multiple labor law violations. On February 26, 2026, Nicheyla Clewos submitted the complaint to the Superior Court of California in Sacramento County against Norcal Individual Care, Inc., alleging various breaches of the California Labor Code and unfair business practices.

Nicheyla Clewos claims that Norcal Individual Care systematically failed to pay minimum and overtime wages, provide meal and rest breaks, maintain accurate work records, reimburse necessary business expenses, and furnish correct wage statements. The complaint details how these alleged practices have impacted Clewos and other similarly situated employees who worked as hourly-paid, non-exempt employees for the company in California. According to Clewos, “Defendants maintained a systematic, company-wide policy” that violated several sections of the California Labor Code. The lawsuit seeks to address these grievances through eight causes of action ranging from failure to pay minimum wages to unfair business practices under the California Business & Professions Code.

The plaintiff alleges that Norcal Individual Care engaged in unlawful conduct by not compensating employees for all hours worked and failing to provide legally mandated meal periods. Additionally, Clewos accuses the company of requiring employees to incur business expenses without reimbursement and not paying all due wages upon termination. These actions allegedly resulted in financial harm to Clewos and other class members. As part of her legal strategy, Clewos is seeking class certification for current and former employees affected by these practices within the applicable statute of limitations period.

In terms of relief sought from the court, Clewos is asking for unpaid wages with interest, statutory penalties for waiting time violations, liquidated damages for unpaid minimum wages, attorneys’ fees, costs incurred during litigation, injunctive relief against future violations by Norcal Individual Care, and restitution under California’s unfair competition laws. The lawsuit aims not only to recover financial losses but also to hold Norcal accountable for its alleged labor law violations.
