Aina further alleges that after raising concerns about potential racial discrimination within the organization, he became a target for retaliation. He recounts being invited to interview for a re-advertised role only to be passed over in favor of less qualified candidates who were White. The complaint also details how remarks about lacking ‘Soft Skills’ were used as pretexts to deny him promotions. These comments were perceived as culturally biased against Aina’s direct communication style typical of an American with Nigerian descent.
The plaintiff is seeking several forms of relief from the court, including injunctions against further retaliatory actions by CalSTRS, compensation for lost promotional opportunities through back pay and unconditional job offers for previously denied positions, punitive damages for emotional distress caused by discrimination, and a mandate for CalSTRS to review its employment policies regarding diversity at all organizational levels. Additionally, Aina requests changes to CalSTRS’s ‘Succession Planning’ process which he argues unfairly benefits White and Asian employees while disadvantaging others.
