Former Employee Alleges Wage Theft Against Coffee Shop Chain

A class action lawsuit has been filed against a California-based coffee shop chain, alleging widespread wage theft and labor violations. The complaint was submitted by Armando C. Delgado on October 27, 2025, in the Superior Court of California, County of Santa Clara, targeting Con Azucar Cafe Inc. and Con Azucar Cafe Shop, LLC. Delgado accuses the defendants of implementing unlawful business practices that systematically deprive employees of their rightful wages and benefits.

The lawsuit outlines numerous grievances against the defendants, including failure to provide required meal and rest breaks, non-payment of overtime and minimum wages, untimely wage payments, and failure to maintain accurate records. According to Delgado’s allegations, these practices are part of a broader strategy by the defendants to cut labor costs at the expense of their employees’ rights under California law. “Defendants have implemented common policies designed to maximize profits at the expense of its non-exempt employees,” states the complaint.

Delgado claims that he and other similarly situated employees were routinely forced to work through legally mandated breaks due to understaffing and excessive workloads. The complaint further alleges that the defendants failed to compensate for off-the-clock work and did not pay proper overtime wages. Additionally, it is claimed that inaccurate wage statements were provided, failing to reflect all hours worked or appropriate rates of pay.

The plaintiff seeks various forms of relief from the court, including compensatory damages for unpaid wages, restitution for unfair business practices, civil penalties under California’s Private Attorneys General Act (PAGA), and injunctive relief to prevent future violations. The lawsuit also demands statutory penalties for failure to provide timely final wages upon termination or resignation.

Represented by Scott Ernest Wheeler and Justin A. Wheeler from The Wheeler Law Firm APC in Claremont, California, Delgado aims to hold Con Azucar accountable for what he describes as “unfair and unlawful business practices.” The case is being presided over by Judge M. Arechiga under Case Number 25CV478645.
