A stucco contractor in Sacramento, California is facing a class-action lawsuit for alleged violations of labor laws, including failure to pay overtime and provide adequate meal and rest breaks. Alfredo Virgen-Navarrete filed the complaint against Future Plastering, Inc. on November 17, 2025, in the Superior Court of California, County of Sacramento.
The lawsuit accuses Future Plastering, Inc., a company specializing in plastering services for residential and business customers, of systemic illegal employment practices that violate multiple sections of the California Labor Code. The plaintiff claims that the company failed to pay employees for all hours worked, did not provide compliant meal and rest periods, and failed to issue accurate wage statements. “Defendant does not properly record nor compensate Plaintiff and other non-exempt employees for the overtime they are owed,” states the complaint. Additionally, it alleges that terminated employees were not paid their due wages promptly.
Virgen-Navarrete argues that he was required to work beyond his scheduled hours without proper compensation. He also claims that he was often forced to skip or cut short his meal breaks due to work demands. “During his five years with the company, Plaintiff was only provided one 45-minute meal break per shift,” the document details. The lawsuit further asserts that Future Plastering’s practices constitute unfair competition under California’s Business & Professions Code.
The plaintiff seeks various forms of relief from the court. These include compensatory damages for unpaid wages and penalties for violations of labor laws. The lawsuit also requests an order requiring Future Plastering to audit its payroll records to determine restitution amounts owed to current and former employees. Furthermore, Virgen-Navarrete seeks injunctive relief to prevent ongoing violations and attorney’s fees.
