Former Employee Alleges Labor Violations Against Construction Company

Arturo Espinosa, a former employee of a construction company, has filed a class action lawsuit against his previous employer, alleging widespread labor violations. The complaint was filed by Espinosa in the Superior Court of California, County of Sacramento on December 12, 2025, targeting TDH Construction Inc., operating as Foothill Painting & Drywall, and its owner Timothy Horner.

Espinosa’s lawsuit claims that TDH Construction Inc. engaged in multiple unlawful labor practices affecting him and other similarly situated employees. According to the complaint, the company failed to pay all wages earned for hours worked at correct rates, provide rest breaks and meal periods as required by law, indemnify employees for necessary work-related expenses, issue accurate wage statements, and timely pay wages upon termination of employment. These allegations are grounded in violations of various sections of the California Labor Code and Business and Professions Code.

The plaintiff accuses TDH Construction Inc. of systematically underpaying its workers by rounding down recorded work hours and not compensating for off-the-clock activities such as answering work-related calls after shifts ended. Additionally, Espinosa asserts that the company did not reimburse employees for business expenses like personal tools and phone usage required for their jobs. He further alleges that TDH failed to maintain accurate records of hours worked and did not factor bonuses into overtime calculations correctly.

Espinosa is seeking restitution for unpaid wages including minimum wage violations, overtime compensation, meal and rest break premiums, liquidated damages, statutory penalties under various labor codes including waiting time penalties for late payment of final wages upon termination. The lawsuit also demands civil penalties under the Private Attorneys General Act (PAGA) due to these alleged violations impacting numerous employees over several years.

Represented by attorney Maralle Messrelian from MM Law APC based in Glendale, California, Espinosa aims to hold TDH Construction Inc., Timothy Horner personally liable due to his role as an owner exercising control over employment conditions.
