In a significant legal move, a former employee has taken action against a prominent landscaping company, alleging widespread labor violations. The complaint was filed by Adolfo Caceres in the Superior Court of California for the County of Sacramento on October 27, 2025, targeting Dominguez Landscape Services, Inc. Caceres claims that the company systematically failed to provide required rest and meal breaks, pay all due wages timely, and reimburse business expenses among other grievances.
The lawsuit outlines multiple allegations against Dominguez Landscape Services. Caceres, who worked as an irrigation worker from April to August 2025, asserts that he and his colleagues were routinely denied paid rest breaks and meal periods as mandated by California Labor Code §§ 226.7 and 512. He further alleges that they were not compensated with premiums for missed breaks. “Defendants required Plaintiff and the Class Members to remain on-duty during meal periods,” states the complaint, suggesting systemic disregard for workers’ rights under state law.
Caceres also accuses the company of failing to issue complete wage statements and not reimbursing employees for necessary business expenses like work-related calls made on personal cell phones. These practices allegedly violate several sections of the California Labor Code including §2802 which mandates employer reimbursement for business expenses incurred by employees.
The plaintiff seeks class-action status to represent all similarly affected workers employed by Dominguez Landscape Services over the past four years. The suit demands various forms of relief including compensatory damages for unpaid wages and penalties under PAGA (Private Attorneys General Act) provisions for labor code violations. Additionally, it seeks restitution under California’s Unfair Competition Law (UCL) for unlawful business practices that gave the company an unfair advantage over competitors complying with labor laws.
Represented by attorneys Mark D. Potter, James M. Treglio, and Jason Kyle Masanque from Potter Handy LLP, Caceres is determined to hold Dominguez Landscape Services accountable not only for his grievances but also on behalf of all affected employees. The case is presided over in Sacramento County under Case No: S55 oss so.
