A tragic incident at a San Francisco property has led to a lawsuit that could reshape the responsibilities of property owners and managers. On August 28, 2025, Marcella Shumpert and Antoinette Shumpert filed a complaint in the Superior Court of California, County of San Francisco, against Westerfeld Apartments, LP; Flynn Family Investments, Inc.; Meridian Management Group, Inc.; Save More Market, Inc.; and several individuals. The plaintiffs are seeking justice for the wrongful death of their mother, Gail Annette Shumpert.
The complaint alleges that on March 17, 2025, Gail Annette Shumpert suffered a fatal fall due to hazardous conditions at the premises located at 1598 McAllister Street. The plaintiffs argue that the defendants failed in their duty to maintain safe conditions on the property. According to the complaint, Gail was directed by an employee named Mike to an unlit and unsecured area leading to a perilous staircase. This staircase was described as narrow, steep, poorly lit, and lacking necessary safety features such as handrails and proper lighting. It is alleged that these conditions were known hazards that had not been addressed by the defendants.
Marcella and Antoinette Shumpert claim that these dangerous conditions directly resulted in their mother’s traumatic brain injury and subsequent death. They allege negligence on part of all defendants for failing to repair or warn about these dangers despite having knowledge of them. The lawsuit highlights violations of various building codes and standards which were allegedly ignored by those responsible for maintaining the property.
The plaintiffs are seeking damages for loss of companionship and support from their mother as well as compensation for funeral expenses and medical costs incurred before her death. They also demand prejudgment interest on economic damages attributable to ascertainable value according to California Civil Code sections 3288 and 3291.
