The complaint was lodged by Laura Castaneda in the Superior Court of California for the County of Sacramento on February 17, 2026, targeting Adalbertos, Inc., Adalbertos Jr., Inc., and several unnamed defendants.
Laura Castaneda’s case revolves around an incident that occurred on August 29, 2024, when she purchased a burrito from an Adalbertos restaurant located at 5104 Marconi Ave., Carmichael, CA. According to the complaint, as Castaneda bit into the burrito, she encountered hard foreign objects that caused her significant injury. The lawsuit accuses the defendants of strict liability for product defects, negligence in their duty to ensure food safety, and breach of implied warranty for merchantability regarding food products.
The plaintiff contends that the defendants were engaged in various stages of production and sale of burritos to the public without adequate inspection or quality control measures. “Plaintiff is informed and believes that at all times herein mentioned, Defendants knew or should have known that plaintiff would consume the BURRITO without inspection for defects,” states the complaint. Castaneda alleges that this lack of oversight led to her biting into hard foreign objects within the burrito.
The lawsuit details how each defendant’s negligent conduct contributed to her injuries. It claims that these entities failed in their responsibility to maintain cleanliness and ensure safety standards were met during manufacturing and distribution processes.
